1.Agreement to these terms

AuctionHouse is operated by Auctionhouse, MB, a company registered in Lithuania (company code 308097132). Our registered address is in "Contact" at the end of these Terms.

These Terms of Service ("Terms") are a binding agreement between you and Auctionhouse, MB ("AuctionHouse", "we", "us"), which operates the AuctionHouse marketplace and related websites, applications and services (the "Platform"). By creating an account, or by accessing or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.

We may update these Terms from time to time (see "Changes to these terms"). Your continued use of the Platform after an update takes effect means you accept the revised Terms.

2.Definitions

  • "Buyer" — a user who purchases a listing or service on the Platform.
  • "Seller" — a user who lists digital goods or services for sale on the Platform.
  • "Listing" — an offer to sell digital goods (such as game accounts, in-game items or currency) or services (such as boosting), together with its description, price and delivery method.
  • "Order" — a transaction created when a Buyer purchases a Listing or accepts an offer on a Boost Request.
  • "Payment Protection" — the arrangement described in "Payment protection and delivery", under which a Buyer's payment may be held or otherwise restricted from release to the Seller until the Order is completed, confirmed or resolved.
  • "Boost Request" — a request a Buyer posts describing a service they want, which Sellers may make offers on; accepting an offer creates an Order on the agreed terms.
  • "Shop" — a selling identity that more than one person may act for, as described in "Shops and teams".
  • "Content" — any text, images or other material you submit to the Platform.

3.Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Platform. By using it, you represent that you meet these requirements.

You are responsible for the accuracy of your registration details, for keeping your credentials confidential, and for all activity under your account. You must verify your email before you can list items. Notify us immediately of any unauthorised use. One person or entity may not maintain multiple accounts to evade limits, fees, moderation or these Terms.

Sellers must provide accurate information regarding whether they are acting as a private individual or as a business or professional trader, and must keep that information up to date. Different consumer rights may apply depending on the Seller's status, and we may display it on the Seller's public profile.

4.Shops and teams

You may sell as yourself, or apply to sell as a Shop. A Shop is a separate selling identity with its own listings, orders, balance and reputation, and more than one person may be given access to act for it. Creating a Shop requires our approval.

Where you invite others to act for your Shop, you decide what they may do, and you remain responsible to us and to Buyers for everything done under that Shop — including listings they publish, orders they fulfil and messages they send. People acting for a Shop must keep to these Terms in their own right, and we may withdraw an individual's access without affecting the Shop.

You may pause a Shop, which hides its listings and stops new orders while existing ones are completed, and you may close it once it has no open orders or balance. Closing a Shop does not delete records we are required to keep — see our Privacy Policy for how long, and why.

5.The marketplace

AuctionHouse is a venue that connects Buyers and Sellers of digital gaming goods and services. We provide payment protection and dispute resolution, and we arrange payment processing through third-party payment providers, to support those transactions. Except where expressly stated, we are not a party to the contract of sale between a Buyer and a Seller, and we do not own, create, or take possession of the digital goods that are traded.

You are responsible for complying with the rules, terms of service and end-user licence agreements of any third-party game or platform that your transaction relates to. Trading may be restricted or prohibited by those third parties, and doing so may carry risk (including to the associated game account); you accept that risk.

6.Listings and prohibited items

Sellers are solely responsible for their Listings, including their accuracy, legality, and the right to sell the goods or services offered. Listings must not be misleading and must accurately describe what the Buyer will receive.

You must not list, sell or attempt to sell:

  • stolen or hacked accounts, or goods or accounts you do not own or have no right to sell;
  • digital goods obtained fraudulently, including through cheating or unauthorised software;
  • malware, or tools designed to compromise accounts or services;
  • anything illegal, or whose sale is prohibited by applicable law;
  • anything involving unauthorised payment methods, or stolen payment information;
  • personal data, or payment instruments;
  • items that infringe a third party's intellectual property or other rights.

We operate risk-based moderation. New sellers' listings are reviewed before they go live, and we may review, pause, remove or reject any Listing at any time. We may require additional verification for higher-risk categories.

7.Game publisher rules

Transactions available through AuctionHouse may violate or be restricted by the terms, rules or policies of the relevant game publisher or game developer.

AuctionHouse is an independent marketplace and is not affiliated with, endorsed by, sponsored by or officially connected with any game publisher unless explicitly stated otherwise.

Users are responsible for understanding and accepting the risks associated with transactions involving third-party games, including possible account suspension, restriction, rollback or termination by the relevant game publisher.

8.Payment protection and delivery

Buyer payments are processed through AuctionHouse and/or our authorised third-party payment partners. Where supported by the applicable payment method, funds may be held or otherwise restricted from release to the Seller until the transaction is completed, confirmed by the Buyer, automatically confirmed under the applicable order rules, or resolved through the AuctionHouse dispute process. The exact payment flow may vary depending on the payment method and payment provider used.

For instant-delivery listings, the agreed content is revealed to the Buyer after payment; revealing it does not by itself complete the Order.

Sellers must deliver exactly what the Listing described, promptly, and must not attempt to reclaim, reverse or invalidate delivered goods (for example by recovering a sold account). Buyers must confirm promptly once they have received and checked their Order.

A Boost Request works the same way once an offer is accepted: accepting creates an Order at the agreed price and scope, the same payment protection applies, and both parties have the same delivery, confirmation and dispute rights as on any other Order. Until an offer is accepted, neither side is committed.

Payments may be processed by third-party payment providers, including crypto-asset payment processors, and are subject to their terms. You are responsible for any network, exchange or transfer fees charged by those providers. We are not responsible for losses arising from incorrect transfer details, chargebacks, or the volatility of crypto-assets.

9.Order confirmation

After the Seller marks an Order as delivered or completed, the Buyer may be given a specified period to review and confirm the Order.

The applicable confirmation period will be displayed on the Order page and may vary depending on the product or service category.

If the Buyer does not confirm the Order or open a dispute within the displayed confirmation period, the Order may be automatically marked as completed.

10.Immediate delivery and withdrawal rights

Certain digital products may be delivered immediately after purchase. Where required by applicable law, we will request the Buyer's express consent to begin delivery before the statutory withdrawal period expires, and acknowledgement that the right of withdrawal may be lost once performance begins.

For services such as Boosting, withdrawal and refund rules may differ, and will be governed by applicable consumer law and the status and progress of the service.

11.Fees

We charge Sellers a commission on each completed sale and may charge Buyers a platform fee, both shown before an Order is confirmed. The buyer platform fee is our own charge for providing checkout, payment protection, dispute resolution and buyer protection. It is retained by us as revenue and is not a reimbursement or pass-through of amounts charged to us by any third-party payment provider. Fees are exclusive of any taxes that may apply.

Seller commission is priced per category, because categories differ in the risk and support they carry; the rate that applies to a Listing is shown before you publish it and again before each Order. Sellers may earn a discount off that rate by trading volume over a recent trailing period, subject to meeting quality conditions; a discount is re-earned rather than permanent, and can be lost. Our current rates and the conditions for each discount tier are published on our fees page.

Withdrawing your balance may carry a separate withdrawal fee, shown before you confirm the withdrawal.

You are responsible for determining and paying any taxes arising from your use of the Platform. We may issue documentation as required by law but do not provide tax advice.

12.Prohibited conduct

You must not:

  • engage in fraud, chargebacks made in bad faith, or any deceptive or manipulative practice;
  • circumvent the Platform to avoid fees or payment protection (for example, arranging payment off-platform);
  • manipulate ratings, tiers or search — including wash trading, fake reviews, or transacting with yourself through additional accounts;
  • harass, threaten, or abuse other users or our staff;
  • attempt to gain unauthorised access to the Platform, other accounts, or our systems, or interfere with their operation;
  • use the Platform in violation of any applicable law, sanctions, or anti-money-laundering requirements.

13.Disputes and refunds

If something goes wrong with an Order, you should first try to resolve it with the other party. If that fails, you may open a dispute.

A Buyer must open a dispute before the applicable order confirmation period expires, or before the transaction is otherwise considered completed under the rules displayed on the Order page.

AuctionHouse may request information or evidence from both parties, and may consider order messages, listing information, delivery evidence and other relevant information when resolving a dispute.

AuctionHouse may issue a full refund, a partial refund, release payment to the Seller, or take another reasonable action depending on the circumstances of the dispute.

Refunds, where granted, are returned using the original payment method where practical. Because many goods are digital and delivered instantly, refunds are handled case by case and are not guaranteed once an Order is confirmed.

14.Your content

You retain ownership of Content you submit. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, display and use that Content as needed to operate and promote the Platform. You are responsible for your Content and must have the rights necessary to share it.

15.Suspension and termination

We may suspend or terminate your access, remove Listings, withhold funds pending investigation, or take other action if we reasonably believe you have breached these Terms or applicable law, or to protect other users or the Platform. You may stop using the Platform and close your account at any time; obligations that by their nature should survive (such as fees owed and liability provisions) will survive termination.

16.Disclaimers and limitation of liability

The Platform is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including as to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted or error-free, or that any Listing, Seller or Buyer will meet your expectations.

To the fullest extent permitted by law, our total liability arising out of or relating to the Platform is limited to the greatest of:

  • the fees you paid to us in the twelve months before the event giving rise to the claim;
  • where the claim relates to an Order, the total amount of that Order; and
  • EUR 500.

That limit does not apply to a Buyer payment held under Payment Protection for an Order. Those funds are never ours to keep, and nothing in this section reduces our obligation to release them to the Seller or return them to the Buyer as described in "Payment protection and delivery" and "Disputes and refunds".

We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill.

Nothing in these Terms limits liability that cannot be limited under applicable law — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for intentional or grossly negligent acts — or affects your statutory rights as a consumer.

17.Indemnification

You agree to indemnify and hold harmless AuctionHouse and its officers, employees and agents from any claims, damages, losses and expenses (including reasonable legal fees) arising out of your use of the Platform, your Content or Listings, or your breach of these Terms or of any law or third-party right.

18.Governing law and disputes with us

These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict-of-laws rules. The courts of the Republic of Lithuania have exclusive jurisdiction over any dispute, except where mandatory consumer-protection law entitles you to bring proceedings elsewhere. EU consumers may have the right to use applicable national or European alternative dispute resolution procedures where required by law.

19.Changes to these terms

We may modify these Terms to reflect changes to the Platform, the law, or our practices. We will post the updated Terms with a new "last updated" date and, for material changes, take reasonable steps to notify you. If you do not agree to a change, you must stop using the Platform.
